John, it was his fault.
As someone pointed out on another forum most people have sharp knives in their kitchens. If you cut yourself, is it the knife's fault? How far down the road of protecting people from themselves and removing any hint of personal responsibility do you want to go?
There is also an issue with thermal cut outs. What happens if say you were rushing someone to hospital, your vehicle stops and won't re-start and as a result the patient dies? The lawyers would have a field day with that one! Unlikely? Of course! But I doubt any manufacturer would be game to try it.

Firstly there is no accounting for stupidity. As Dave commented, WHY did he leave the bike running for so long, that I'd love to know. But a failsafe for over temperature would be an easy fix. The only 2 things you need to measure is temperature and motion in this instance. Many bikes these days have temp sensing and accelerometers as standard fitment and Micros are found in many locations on a bike so there may not even be a need to add one. 2 signals determine an approaching unsafe engine temp and that the bike has not moved for a period of time and it shuts down. Simple stuff! While not excusing the moron who left his bike running, it would be a cheap insurance policy!

You could argue what happens if while rushing to hospital your vehicle overheats and expires as in this case with the Griso. I'd rather something detect an approaching failure and shut down before damage, than allow it to occur. Either way, a fault occurs and renders the item unusable. For what period and in what state it remains is the debate between thermal management and not. I know which option I would prefer.

No doubt the operators fault. Agreed.
There are intelligent ways to help avert human error without opting 'control'.
Like when your Ducati 1098 gets hot, it roasts your yarbles thereby reminding you to check the temp gauge.....
